Online shop

Please have in mind that although care is taken to ensure that the display of appearances, colors, textures, or finishes is accurate, what you will see on your dispositive (monitor, cellphone, etc) may differ, and therefore we cannot guarantee that images are an accurate representation of the actual items that you are purchasing.

All reasonable care is taken to ensure that the details displayed for a particular item offered for sale are correct at the time when the information was entered onto the system.

Conclusion of contract

  • The presentation of items in the online store, the selection of items and placement into the shopping cart do not constitute a legally binding agreement for the conclusion of a purchase contract. Rather, it is a non-binding invitation to order items in the online store.
  • After proceeding to Check-out, by clicking the button “Place Order” you submit a binding offer to purchase (§ 145 BGB).
  • After placing the order, you will receive an automatically generated e-mail confirming that we have received your order (confirmation of receipt). This confirmation of receipt does not constitute an acceptance of your purchase offer. A contract is not yet concluded by the confirmation of receipt.
  • A purchase contract for the items shall only be concluded if we expressly declare acceptance of the purchase offer or if we dispatch the items to you – without prior express declaration of acceptance.

Terms of payment

Payments can be executed via credit card /debit card and G pay.

  • When paying by credit card the purchase price at the time of the order on your credit card reserved (“authorization”). The actual charge to your credit card account will occur at the time we ship the goods to you.
  • In the case of payment by direct debit, you shall bear any costs incurred as a result of a chargeback of a payment transaction due to a lack of funds in your account or due to incorrect bank details provided by you.

Prices

Prices indicated in the online store are total prices. According to § 19 UStG, no VAT is charged. Delivery costs will be indicated separately.


Shipment and delivery conditions.

  • The items shall be delivered to the address specified by you, unless otherwise agreed.
  • The items remain our property until full payment of the purchase price.
  • If the item is returned because it was not possible to be delivered to the address provided by you. The client takes the cost of the failed dispatch.
  • If items might be delivered to countries outside the European Union, the additional cost of such transaction (delivery costs, customs duties, taxes, money transfer fees) will be covered by the client.
  • When the client collects the items him/herself, the seller will inform through e-mail when the items are ready. In this case, the shipment will not be charged.

Transport damage

  • If items are delivered with evident transport damage, please complain about such defects immediately to the delivery agent and contact us as soon as possible.
  • Failure to make a complaint or contact us has no consequences for your statutory warranty rights. However, they help us to be able to assert our own claims against the carrier or the transport insurance.

Delivery

  • Delivery costs: Free delivery for originals no bigger than 21×30 cm shipping within Germany and the European Union. For original items bigger than 21×30 cm we charge shipping costs of 4,00 € per order within Germany and 7,00 € within the European Union.
  • Dispatch: We dispatch orders on Tuesdays of the following week after receiving the order.
  • Delivery times: standard shipping (can take between 2-5 days after dispatch).

Right of Withdrawal

Right of Withdrawal for consumer (§13 BGBgerman law):
A consumer is any natural person who concludes a legal transaction for purposes which can be attributed mostly neither commercial nor self-employed.
You as a consumer have the right to withdraw this contract within 14 days without giving reasons.
The cancellation period is fourteen (14) days from the day, you or a third party named by you, other than the carrier, have taken the items in possession. To apply your right of withdrawal you have to inform us about your decision to cancel this contract by a clear statement to:

Exclusion and/or premature expiration of the right to cancel

  • The right to cancel is excluded for contracts for the supply of goods that are made to the client’s specifications or are clearly personalized (commissions, or commissioned works)

Effects of withdrawal

  • If you cancel this contract, we will reimburse you all payments received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the most favorable standard delivery offered by us), without undue delay and within fourteen days after the day on which we are informed about your revocation of this contract.
  • We will make the reimbursement using the same means of payment that you used in the original transaction unless you explicitly agreed otherwise.
  • In any event, you will not incur any fees as a result of the reimbursement.
  • We may withhold reimbursement until we have received the items back or you have supplied evidence of having sent back the items, whichever is the earliest.
  • You shall send back the items or hand them over to us without undue delay and, in any event, not later than fourteen days from the day you communicate your cancellation of this contract to us.
  • The deadline is met if you send back the items before the period of 14 days has expired.
  • You will bear the direct cost of returning the items.
  • We may make a deduction from the reimbursement for loss in value of any items supplied if the loss is the result of inappropriate handling by you.
  • You are only liable for any diminis0hed value of the items resulting from the handling other than what is necessary to establish the natu0re, characteristics, and functioning of the items.

Recommendations

  • Please, prevent damage and contamination of the items. To avoid accidentally damaging an item, for example, if an artwork is unframed, leave all unpacking and handling of the artwork to a trusted professional framer or art handler.
  • Please return the items, if possible, in the original packaging with all accessories and all packaging components. If necessary, please use protective outer packaging. If you are no longer in possession of the original packaging, please use suitable packaging providing adequate protection against transport damage in order to avoid claims for damage due to defective packaging.
  • Before returning the items, please write an e-mail to hello@beatrizherrera.com to announce the return. In this way, you enable us to allocate the products as quickly as possible.

Note that not following the recommendations doesn’t affect your right to Withdrawal.

Proprietary rights

  • In advance deliveries, the seller retains the title of ownership to the delivered items until those have been fully paid

Final provisions

  • Should one or more provisions of these General Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions.
  • Contracts between you and us shall be governed exclusively by German law to the exclusion of the provisions of the United Nations Convention on Contracts for the International Sale of Goods (CISG, “UN Sales Convention”).

 Alternative Dispute Resolution pursuant to Art. 14 (1) ODR Regulation and § 36 VSBG:

The European Commission provides a platform for online dispute resolution (OS), which you can find at https://ec.europa.eu/consumers/odr. We are not obliged or willing to participate in a dispute resolution procedure before a consumer arbitration board.
