Right of Withdrawal

Right of Withdrawal for consumer (§13 BGB German law):
A consumer is any natural person who concludes a legal transaction for purposes which can be attributed mostly neither commercial nor self-employed.
You as a consumer have the right to withdraw this contract within 14 days without giving reasons.
The cancellation period is fourteen (14) days from the day, you or a third party named by you, other than the carrier, have taken the items in possession. To apply your right of withdrawal, you have to inform us about your decision to cancel this contract by a clear statement to:

Exclusion and/or premature expiration of the right to cancel.

  1. The right to cancel is excluded for contracts for the supply of items that are made to the client’s specifications or are clearly personalized (commissions, or commissioned works)

Effects of withdrawal

  1. If you cancel this contract, we will reimburse you for all payments received from you, including delivery costs, without undue delay and within fourteen days after the date on which we are informed about your revocation of this contract. Additional costs are not included if you have chosen a type of delivery other than the most favorable standard delivery offered by us.
  2. We will make the reimbursement using the same means of payment that you used in the original transaction, unless you explicitly agreed otherwise.
  3. In any event, you will not incur any fees as a result of the reimbursement.
  4. We may withhold reimbursement until we have received the items back, or you have supplied evidence of having sent back the items, whichever is the earliest.
  5. You shall send back the items or hand them over to us without undue delay and, in any event, not later than fourteen days from the day you communicate your cancellation of this contract to us.
  6. The deadline is met if you send back the items before the period of 14 days has expired.
  7. You will bear the direct cost of returning the items.
  8. We may make a deduction from the reimbursement for loss in value of any items supplied if the loss is the result of inappropriate handling by you.
  9. You are only liable for any diminished value of the items resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the items.

Recommendations

  1. Please, prevent damage and contamination of the items. To avoid accidentally damaging an item, for example, if an artwork is unframed, leave all unpacking and handling of the artwork to a trusted professional framer or art handler.
  2. Please return the items, if possible, in the original packaging with all accessories and all packaging components. If necessary, please use protective outer packaging. In order to avoid claims for damage due to defective packaging, please use suitable packaging providing adequate protection against transport damage.
  3. Before returning the items, please write an e-mail to hello@beatrizherrera.com to announce the return. In this way, you enable us to allocate the products as quickly as possible.
